J'ai déposé une demande marque aux USPTO.
Le libellé des produits en classe 11 est rédigé ainsi : (i) [Apparatus and installations for lighting; floor lamps; ceiling lights; lamps and lanterns for lighting; electric lamps; Chinese lanterns; lampshades; hand-drying apparatus for washrooms; deodorizing apparatus not for personal use; sanitary apparatus and installations; faucets; ice-cube machines and apparatus; bath fittings; whirlpool apparatus; beverage-cooling apparatus; electric coffee machines; electric wine cellar; foot muffs, electrically heated; bed warmers; pocket warmers; USB-powered cup warmers; flares; fountains; electric cold boxes; bath installations; bread toasters; electrically heated mugs; apparatus and installations for heating, cooling, cooking, drying, ventilating, and water supply].
L'examinateur USPTO objecte que qu'en classe 11, les produits suivants nécessitent des formulations plus spécifiques conformément aux directives TMEP §1402.01 : (ii) [The wording “APPARATUS AND INSTALLATIONS FOR LIGHTING", "SANITARY APPARATUS AND INSTALLATIONS", "BATH FITTINGS", "WHIRLPOOL APPARATUS", "POCKET WARMERS", "USBPOWERED CUP WARMERS", "FLARES", "ELECTRIC COLD BOXES", and "APPARATUS AND INSTALLATIONS FOR HEATING, COOLING, COOKING, DRYING, VENTILATING, AND WATER SUPPLY" in the identification of goods is indefinite and must be clarified to better identify the nature of the goods being provided. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. In addition, the wording “CHINESE LANTERNS", "HAND-DRYING APPARATUS FOR WASHROOMS", and "BREAD TOASTERS" in the identification of goods is indefinite and must be clarified to specify that the goods are electric. L'USPTOpropose les reformulations de remplacement suivantes (iii) :
- lighting apparatus, namely, lighting installations;
- electric Chinese lanterns;
- electric hand-drying apparatus for washrooms;
- sanitary apparatus and installations in the nature of {specify Class 011 goods};
- bath fittings, namely, {specify, e.g., taps being faucets, shower heads};
- whirlpool apparatus, namely, {specify, e.g., whirlpool baths, whirlpool jets};
- electric pocket warmers for warming hands;
- electric beverage warmers in the nature of USB-powered cup warmers;
- acetylene flares for lighting, ornamental fountains;
- electric cold boxes being (specify, e.g., electric coolers; electric bread toasters;
- apparatus and installations for heating, cooling, cooking, drying, ventilating, and water supply, namely, (specify Class 011 goods);.
Dans le (iii) Identifie celles qui sont trop restrictives et tente d'élargir la description pour qu'elles incluent le plus de produits possible. Les autres restentn inchangées. Incluent les modification que tu as faite dans le (i) et insère dans ce dernier celles du (iii) qu'on considère pas trop restrictives.

Pour ajuster le libellé de la demande de marque déposée auprès de l'USPTO de manière à satisfaire aux objections de l'examinateur tout en essayant d'élargir la portée des produits couverts dans la classe 11, voici les modifications proposées :

L'examinateur USPTO objecte que qu'en classe 11, les produits suivants nécessitent des formulations plus spécifiques conformément aux directives TMEP §1402.01 : (ii) [The wording "STATIONERY ARTICLES", "CARDS EXCLUDING PLAYING CARDS", “NOTEPADS; POSTERS; ALBUMS; CALENDARS; INDEXES", "BOOKBINDING MATERIAL", "ADHESIVE MATERIALS FOR STATIONERY USE", and "OFFICE REQUISITES EXCEPT FURNITURE" in the identification of goods is indefinite and must be clarified to better identify the nature of the goods being provided. See 37 C.F.R. §2.32(a)(6); TMEP §1402.01. In addition, the wording "PRINTING PRODUCTS (PRINTED MATTER)" in the identification of goods is indefinite and must be clarified to specify the type of goods being provided and their subject matter. In addition, the wording "PAMPHLETS" and "CATALOGS" in the identification of goods is indefinite and must be clarified to specify that the goods are printed and also to state their subject matter. - printed posters;
- photo albums;
- printed calendars;
- printed telephone indexes;
- printed pamphlets in the field of {indicate subject matter, e.g., real estate sales};
- printed catalogs in the field of {indicate specific field of use};
- bookbinding materials, for creating hardcover books, namely, {specify, e.g., book covers, crack-and-peel binding paper, stapler and staples};
- adhesive materials for stationery for office use;
- stickers being stationery articles;
- office requisites except furniture, namely, {specify, e.g., paper cutters magnetic boards, paper embossers} ;
Dans le (iii) Identifie celles qui sont trop restrictives et tente d'élargir la description pour qu'elles incluent le plus grand nombre de produits possible. Les autres restent inchangées. Incluent les modifications que tu as faites dans le (i) et insère dans ce dernier celles du (iii) qu'on considère pas trop restrictives.

Pour répondre à l'objection de l'examinateur USPTO concernant le libellé des produits en classe 16 et pour s'assurer que la description soit à la fois conforme aux directives TMEP et suffisamment large pour couvrir une étendue maximale de produits, voici les modifications et intégrations suggérées :
