Le libellé des services en classe 43 est rédigé ainsi : (i) [temporary accommodation services; rental of temporary accommodation; rental of holiday accommodation; temporary accommodation reservation; agency services for the reservation of temporary accommodation; information and advice with respect to temporary accommodation; providing information online through websites with respect to temporary accommodation rental; providing ratings and reviews of temporary accommodations online through websites; temporary accommodation hospitality services [management of entry/exit and handing over keys]; hotel accommodation services; hotel reservations; take-away food and beverage services; hotel catering services; restaurant services; bar services; catering services; providing chef services at home; providing childcare services].
Sur le fondement des directives TMEP §1402.01, l'examinateur de l’USPTO indique ce qui suit : (ii) [TEMPORARY ACCOMMODATION SERVICES", "INFORMATION AND ADVICE WITH RESPECT TO TEMPORARY ACCOMMODATION", "PROVIDING INFORMATION ONLINE THROUGH WEBSITES WITH RESPECT TO TEMPORARY ACCOMMODATION RENTAL", "TEMPORARY ACCOMMODATION HOSPITALITY SERVICES [MANAGEMENT OF ENTRY/EXIT AND HANDING OVER KEYS]", "HOTEL RESERVATIONS", and "TAKE-AWAY FOOD AND BEVERAGE SERVICES", "PROVIDING CHEF SERVICES AT HOME" in the identification of services requires amendment to clarify to specify the type of services being provided.]
L'USPTO propose les reformulations de remplacement suivantes (iii) :
- hospitality services in the nature of provision of temporary accommodation services;
- temporary accommodation reservations;
- providing information and advice in the field of temporary accommodation;
- providing information online through websites with respect to the rental of temporary accommodation;
- hospitality reception services in the nature of management of arrivals and departures of guests and conferment of keys for guests in temporary accommodations;
- making hotel reservations for others;
- take-away food and beverage restaurant services;
- providing personal chef services at home.
Dans le (iii) identifie celles qui sont trop restrictives. Propose d'élargir la description pour qu'elles incluent les services les plus larges possibles en veillant à conserver leur sens original et leur conformité aux directives TMEP §1402.01 (iv). Les autres seront acceptées. Incluent les modifications que tu as faites dans le (i) et insère dans ce dernier celles du (iii) qu'on ne considère pas restrictives. Indique en gras les (iii) acceptées et les (iv).

Pour répondre à votre demande, je vais commencer par identifier les reformulations proposées par l'USPTO qui peuvent être considérées comme trop restrictives, puis je proposerai des libellés élargis qui respectent les directives du TMEP §1402.01 tout en conservant le sens original des services offerts. Les services dont les reformulations ne sont pas jugées restrictives seront intégrés tels quels dans le libell
